GENERAL PURCHASE CONDITIONS

Each time you use any present or future service of INDIDOGS SL (hereinafter, INDIDOGS) you will also be subject to the general terms and conditions and the specific conditions applicable to said service.

Before carrying out any procedure or action, it is advisable to carefully read the present conditions detailed below.

INDIDOGS' aim is to ensure the best treatment and availability for its CUSTOMERS. In the event that the services offered by INDIDOGS cannot be accessed, an attempt will be made to resolve the issue as quickly as possible to ensure the best possible access for the CUSTOMERS.

The CLIENT declares that he/she is of legal age and has the necessary legal capacity to use this website in accordance with the General Conditions stated herein, which he/she understands and comprehends in their entirety.

All orders are subject to product availability. Therefore, if there are difficulties in supplying products or if there are no items in stock, INDIDOGS reserves the right to provide information about substitute products of equal or higher quality and value that you may order.

If you wish to receive the product you initially selected, you can select a new delivery date on which the product is estimated to be available again.

Another option would be to proceed with the refund of the amount paid for the item. INDIDOGS will not be liable for delays or failure to comply with obligations if this is not attributable to INDIDOGS. This will not prevent the CUSTOMER from receiving the product or contracted service as soon as possible, or, where appropriate, receiving the appropriate compensation.

INDIDOGS reserves the right to make changes to its services, policies and terms and conditions, including these General Conditions. The CUSTOMER will be subject to the terms and conditions, policies, Conditions of Use and General Conditions of the Services in force on the date on which the services are used.

If any of these General Conditions is declared invalid, void or ineffective for any reason, said condition shall be deemed excluded without said declaration affecting the validity or enforceability of the remaining conditions.

1. PURCHASE 

In order to make purchases on the INDIDOGS website, it will not be necessary for the USER to register on the website, although they will have the possibility to do so to facilitate future purchases, have access to their history or repeat recurring purchases.

The CUSTOMER must enter their data each time they wish to make a purchase, unless their cookie settings state otherwise or they already have or decide to create a user on www.indidogs.com.

For increased security, no bank details provided will be retained. This means that bank details will have to be entered each time an order is placed on the website.

Purchases made on this website must be made in Spanish or English.
Shipments will be made throughout Spain, except the Canary Islands, Balearic Islands, Ceuta and Melilla. 

All prices include legally applicable taxes (VAT).

We do not have a minimum order, but frozen products are only sent to Barcelona to facilitate the cold chain and freezing conditions. Shipping costs will be 7,90 euros per shipment for orders equal to or less than 25€. Orders between 25€ and 55€ will cost 3,90€, and orders over 55 euros will be free of shipping costs. The final price will be communicated to the CUSTOMER in advance before formalizing the transaction.

The CUSTOMER agrees to pay at the time of placing the order.

COUPONS for first purchases will have a single and exclusive use per family unit and at the same address.  

Any product bearing the name WEB TEST will not be processed.

2. DELIVERY CONDITIONS

When placing your order, you will have the option to choose the delivery date. It is the customer's responsibility to ensure that someone will receive the order on the chosen day and within the indicated times. The chosen delivery day and time indicated are estimated, not guaranteed.There may be isolated cases of delays caused by couriers. In these cases, the customer agrees to facilitate receipt on another day or time slot. Delivery delays cannot give rise to the rejection of the order or a claim.

Any changes to be made to orders once they have been processed must be notified at least 24 hours before delivery of the order outside of Barcelona, ​​and 2 hours before delivery of the order for Barcelona.

Please be very aware of the date you choose, as you are responsible for receiving the order within the indicated times, since our products are frozen foods.

It is the CUSTOMER's responsibility to check the shipping address and postal code, since INDIDOGS is not responsible for additional costs for reshipping or returning the product in the event that any of these data provided by the CUSTOMER are incorrect.

In rare cases and due to the logistics processes of courier companies, the order may arrive later than the indicated date and time. 

INDIDOGS reserves the right to select a different transport company to the one chosen by the CUSTOMER if delivery is more efficient in that area or the characteristics of the order are more appropriate to the type of delivery. This may lead to variations in the day and time of delivery.

Do not choose a holiday as your delivery date.

The transport company does not operate on local or national holidays and your order will not be delivered until the next business day, putting the cold chain at risk. DO NOT CHOOSE A HOLIDAY as the delivery date, contact us via email at indidogs@outlook.com or by phone at 93 115 72 12 if you need to change the delivery date. 

Claims cannot be accepted for products whose quality has been affected by the selection of a public holiday as a delivery date and the delays that this causes.

Important information 

In the event that the delivery time is extended for personal reasons of the customer during the selected delivery day, INDIDOGS is not responsible for any defrosting that the products may experience and the possible impact on their quality. In these cases, Indidogs will not accept returns or authorize compensation to the consumer. 

If the order cannot be delivered on the first attempt due to the CUSTOMER's absence and within the indicated time slot, depending on the location, a second delivery attempt may be made on the same day in the afternoon. In some areas, to make the second delivery attempt on the same day, it is necessary to pay an additional cost for mileage, which must be paid by the CUSTOMER to INDIDOGS.

In the case of frozen food, if delivery is not possible due to the customer's lack of response and/or new absence, the merchandise will be destroyed 24 hours after the second delivery attempt, with the customer losing the entire amount of the order and shipping costs.

If the order cannot be delivered on the first attempt due to an error in the address provided by the CUSTOMER, the CUSTOMER will be responsible for paying the costs corresponding to the reshipment of the shipment.

The phone number provided for shipping must be a Spanish mobile number.

Any changes you wish to make to your order once it has been processed must be notified at least 24 hours before delivery of the order.

In the unlikely event that the order does not arrive the day AFTER the scheduled delivery date, the customer must indicate this by email within a period of 24 hours, providing INDIDOGS with the order reference number and the scheduled delivery date.

INDIDOGS is responsible for investigating the reason and responding within an additional 24 business hours from receipt of the customer's email. If, as a result of the investigation, Indidogs does not obtain an appropriate reason for non-delivery of the order, or the order itself or a signed proof of delivery of the order cannot be located, Indidogs will consider that order as "lost". In this case, although it is not INDIDOGS' responsibility, the customer may cancel their order and Indidogs will refund the amounts paid in full, or the replacement of the order will be arranged on an alternative date.

3. PAYMENT METHOD

The CUSTOMER must pay the amount corresponding to his order using the following payment methods:

  • PAYPAL (credit card, direct debit, bank transfer, etc.): This is an online payment service that guarantees 100% secure, easy and fast payment. By selecting this payment method, you will be redirected to PayPal in the next step. When the required data has been completed, you will automatically be returned to this store to complete the order.
  • BANK TRANSFER: the bank transfer must be made at least 24 hours before the day of delivery of the order. It is essential that the CUSTOMER sends proof of the transfer to INDIDOGS, via email, for the order to be processed. Once this time limit has passed without INDIDOGS having received notification and confirmation of payment, the order will be cancelled.

  • CREDIT CARD: Credit and debit card holders are subject to validation and authorization by INDIDOGS, as well as by the issuing entity, in order to maintain security and prevent fraud. Internet fraud is a crime and the offender will be prosecuted by law. Payment will not be taken for any item until it has been processed. However, it will be done through authorization. 
  • BIZUM

In the event that INDIDOGS (INDIDOGS SL) is unable to fulfil the order, the bank will be immediately asked to cancel the authorisation. If the authorisation remains active after several days, the CUSTOMER must contact their bank and request that they process the cancellation of the payment.

4. AFTER-SALES

INDIDOGS will confirm the purchase of the products from the website by email, informing the CUSTOMER about the products purchased, the selected delivery date and receipt of payment. The email will include a document proving the transaction, which will include all the essential conditions of the transaction, known and accepted by the CUSTOMER, as well as the corresponding invoice.

5. TERMS AND SHIPPING

The deadline for executing the order will not exceed 30 calendar days from receipt of payment by the CUSTOMER.

In the event of circumstances not attributable to INDIDOGS, the company shall not be liable for any delays. When the purchased product is sent to the CUSTOMER, the risk of loss or damage thereof shall be transferred to the CUSTOMER when he or a third party indicated by him, other than the carrier, has acquired physical possession of it.

The customer has the option to choose the delivery date on the days that INDIDOGS has enabled at that time. 

If the purchase made contains an applied promotion, the delivery date cannot be modified.

INDIDOGS does not guarantee delivery on the selected date.

Occasionally, due to courier logistics processes or stock shortages of the selected products, the order may be subject to changes in the selected delivery date.

Please remember that you should not choose holidays in the destination town of the order as the delivery day because this may compromise the cold chain of the product, and in these cases INDIDOGS will not assume responsibility.

6. RIGHT OF WITHDRAWAL AND/OR RETURN

General information about both rights

The same means of payment used for the original transaction will be used, unless otherwise expressly agreed. In any case, the CUSTOMER will not be responsible for any fees that may arise from such reimbursement. If the CUSTOMER chooses a less expensive delivery method, INDIDOGS will not be obliged to reimburse the additional costs arising therefrom.

Once the return or exchange has been authorised, INDIDOGS will collect the products from the postal address indicated by the customer. INDIDOGS may withhold reimbursement until the items returned by the CUSTOMER have been received.

Withdrawal

The right of withdrawal or exchange does not apply in the case of contracts whose object is frozen products. In these cases, INDIDOGS cannot accept returns, exchanges or cancellations of contracts unless the frozen products arrive in a damaged, defrosted, defective condition or have not been ordered by the customer, in which case, the CUSTOMER must photograph the product received at the time of delivery.

The right to withdraw from the contract will apply exclusively to those products that are returned in the same condition in which the customer received them. No refund will be made if the product has been opened, used or if it has suffered any damage, so the customer must be careful with the products while they are in their possession. INDIDOGS will not accept returns or exchanges if the product is not presented in perfect condition.

To exercise this right, the CLIENT must communicate the desire to withdraw to the following email address: indidogs@outlook.es

Once this statement is received, receipt of the request by INDIDOGS will be confirmed.

The costs of returning and shipping the product in the event of withdrawal will be borne by the CUSTOMER.

Return

In the case of returning defective products, the period begins on the day after receipt of the product. The customer must inform us within 14 calendar days of receiving the product.

INDIDOGS will refund the price of the product and the ordinary shipping costs corresponding to the shipping option offered within 14 days of notification of the communication.

The return period for items will be 14 calendar days from the communication of the withdrawal or from the notification of the defect of the item. The return will not entail any cost for the CUSTOMER, unless upon receipt of the returned shipment INDIDOGS determines that the product is not defective due to its content, quantity, quality and/or type. In this last case, the CUSTOMER will be responsible for the costs of returning the product.

IMPORTANT

There may be isolated cases of delays caused by couriers. These delivery delays cannot give rise to the rejection of the order or a claim.

In the event that delivery times are extended because the CUSTOMER is unable to collect the delivery for any reason on the chosen delivery day, INDIDOGS is not responsible for the defrosting of the products, the possible impact on their quality and on the health of the pet due to feeding them with them. INDIDOGS cannot accept returns, exchanges or cancellations of contracts in these cases.

INDIDOGS cannot be held responsible for failure to fulfill any aspect of the delivery of the order arising as a result of incorrect information provided by the CUSTOMER. In such cases, the customer may be liable for the cost of delivery, return of the goods and product cost.

The rights recognized by current legislation are protected.

7. WARRANTY

The CUSTOMER is protected under the terms of the guarantee provided for in Articles 114 of the Revised Text of the Consumer and User Protection Act, Royal Legislative Decree 1/2007, of November 16.

These conditions shall be governed and interpreted in accordance with Spanish law, expressly excluding the application of the United Nations Convention on Contracts for the International Sale of Goods.
